Terms and Conditions – BudFin

These Terms and Conditions ("Terms") govern your access to and use of the BudFin mobile application ("App", "Service") operated by J AND K WEB COLLECTIVE (PTY) LTD ("Company", "we", "us", "our").
By downloading, installing, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.
1. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the App.
The App is not intended for children under 13 years of age.
2. Nature of the Service
BudFin is a personal budgeting and financial tracking tool designed to assist users in managing income, expenses, budgets, and financial goals.
The App does not provide financial, investment, legal, tax, accounting, or professional advice. All financial decisions remain solely your responsibility.
3. No Financial Advice Disclaimer
The information, analytics, summaries, forecasts, and insights provided by the App are for informational and organisational purposes only.
- We are not a financial institution.
- We do not provide investment advice.
- We do not provide credit scoring or lending services.
- We do not guarantee financial outcomes.
You should consult a qualified professional before making financial decisions.
4. User Responsibilities
You agree to:
- Provide accurate information where required
- Maintain the confidentiality of your login credentials
- Use the App in compliance with all applicable laws and regulations
- Not attempt to reverse engineer, decompile, disassemble, or exploit the App
- Not misuse the App for fraudulent, harmful, or unlawful activity
You are solely responsible for the accuracy of any financial data you enter into the App.
5. Account and Authentication
The App may support Google Sign-In via Firebase Authentication for account-based features such as cloud sync.
You are responsible for safeguarding your Google account credentials. We reserve the right to suspend or terminate access where we reasonably believe there is abuse, fraud, security risk, or a breach of these Terms.
6. Subscriptions and Payments
Certain features may require a paid subscription ("Pro").
All payments are processed through Google Play Billing. We do not collect or store payment card information, and Google Play is the source of truth for subscription entitlement status.

6.1 Auto-Renewal
Subscriptions renew automatically unless cancelled via Google Play prior to the renewal date.
6.2 Cancellation
You may cancel at any time through your Google Play subscription settings. Access to paid features continues until the end of the current billing period.
6.3 Refunds
Refunds are governed by Google Play’s refund policies. We do not issue refunds directly.
6.4 Pricing Changes
We may modify subscription pricing or introduce new plans from time to time. Any changes apply prospectively and may be communicated through Google Play and/or in-app messaging where appropriate.
6.5 Trials, Discounts, and Offers
Free trials, introductory prices, discounts, promotional offers, and regional pricing may be offered, changed, or withdrawn through Google Play. Eligibility, duration, pricing, renewal terms, and redemption requirements are controlled by Google Play and shown during checkout before purchase.6.6 Promotional Codes
We may issue Promotional Codes through Google Play that provide free downloads, trials, or access to certain features or in-app items.
Promotional Codes:
- Have no cash value
- May not be sold, transferred, or exchanged for payment
- Are issued for promotional purposes only (including customer acquisition, retention, or early reviewer purposes)
- May be subject to expiration dates, usage limits, geographic restrictions, or account limitations
- Must be redeemed in accordance with Google Play’s requirements and policies
We reserve the right to revoke or refuse Promotional Codes where we reasonably suspect misuse, fraud, abuse, or violation of these Terms.
Google may terminate, restrict, suspend, change, or cancel Promotional Codes or the Promotional Code program at any time without prior notice.
7. Advertisements
The free version of the App may display advertisements provided by Google AdMob.
We are not responsible for third-party advertising content and do not warrant the availability, accuracy, or suitability of any third-party advertisement.
8. Intellectual Property
All intellectual property rights in and to the App, including trademarks, logos, content, design, and software code, are owned by J AND K WEB COLLECTIVE (PTY) LTD (or its licensors) and are protected by applicable laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
You may not copy, modify, distribute, sublicense, sell, or create derivative works from the App.
9. Privacy and Data
Your use of the App is also governed by our Privacy Policy.
You retain ownership of your personal data. We process and store data solely to provide and improve the Service, as described in the Privacy Policy.
10. Service Availability
We aim to provide a reliable Service, but the App is provided on an "as is" and "as available" basis.
We may modify, suspend, or discontinue the App (or parts of it) at any time, including for maintenance, security, performance, or compliance reasons.
11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED OR ERROR-FREE
- DEFECTS WILL BE CORRECTED
- THE APP IS FREE OF HARMFUL COMPONENTS
- OUTPUTS, INSIGHTS, OR CALCULATIONS ARE COMPLETE OR ACCURATE
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- J AND K WEB COLLECTIVE (PTY) LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR ANY FINANCIAL LOSSES OR OUTCOMES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON APP OUTPUTS
- OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM
Some jurisdictions do not allow certain limitations, so these may not apply to you in full.
13. Indemnification
You agree to indemnify and hold harmless J AND K WEB COLLECTIVE (PTY) LTD, its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
14. Termination
You may stop using the App at any time.
We may suspend or terminate your access if you breach these Terms or if we reasonably believe termination is necessary to protect users, the Service, or comply with legal obligations.
Sections intended to survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will survive.
15. Governing Law
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law rules.
Any disputes shall be subject to the jurisdiction of the competent courts of South Africa.
16. Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date and may provide additional notice for material changes.
Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
