Terms and Conditions – MyFiTrack

Welcome to MyFiTrack. These Terms and Conditions (“Terms”) govern your use of the MyFiTrack mobile application (“App”, “Service”) operated by J AND K WEB COLLECTIVE (PTY) LTD (“we”, “us”, “our”).

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)

  • You have the legal capacity to enter into these Terms

  • You will comply with all applicable laws and regulations

  • You accept these Terms and our Privacy Policy

2. Description of the Service

MyFiTrack is a personal health and fitness tracking application that allows you to:

  • Track body measurements (weight, body dimensions, BMI)

  • Monitor water intake

  • Log exercise and physical activities

  • Track sleep patterns

  • Set and monitor fitness goals

  • View analytics and progress over time

  • Earn achievements for reaching milestones

  • Sync data across devices (with account registration)

3. Account Registration and Security

3.1 Account Creation

Certain features of the App may be used without an account. To access cloud synchronization and multi-device features, you must sign in using Google Sign-In via Firebase Authentication.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials

  • All activities conducted under your account

  • Notifying us immediately of any unauthorized access or security breach

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or misuse the App.

4. Health and Fitness Disclaimer

4.1 Not Medical Advice

IMPORTANT: MyFiTrack is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App provides general health and fitness tracking tools for informational purposes only.

4.2 BMI Calculations

BMI calculations are based on standard formulas and have known limitations. BMI may not accurately reflect health status for all individuals, including:

  • Athletes with high muscle mass

  • Elderly individuals

  • Pregnant women

  • Children and adolescents

  • Individuals with certain medical conditions

Always consult a qualified healthcare professional for medical advice.

4.3 User Responsibility

You acknowledge that:

  • Any decisions made based on App data are your sole responsibility

  • You should consult a healthcare professional before starting any fitness program

  • The App is not a substitute for professional medical advice

  • You use the App at your own risk

5. Subscriptions and Billing

5.1 Free and Premium Features

The App offers both free and premium (“Pro”) features. Premium features require a paid subscription.

Google Play is the source of truth for subscription entitlement and billing status on Android.

5.2 Subscription Terms

  • Subscriptions are billed through the Google Play Store

  • Payment is charged to your Google Play account upon confirmation

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period

  • Renewal charges occur within 24 hours prior to the end of the current period

  • Free trials, introductory pricing, discounts, and other store-managed offers are administered by Google Play when available

  • Entitlement status, renewals, expirations, grace periods, account holds, and refunds are determined by Google Play records

  • We may keep a local entitlement cache on your device for offline continuity, but we do not use Firebase or Firestore as the source of truth for paid access

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time via Google Play Store settings

  • Access to premium features remains until the end of the billing period

  • Refunds are governed solely by Google Play Store policies

  • We do not process refunds directly

5.4 Price Changes

Subscription prices may change. Any price changes will be communicated in advance and will not affect the current billing period.

5.5 Lifetime Purchases

If offered, lifetime purchases grant access to premium features as available at the time of purchase. We reserve the right to modify or discontinue features with reasonable notice.

5.6 Promotional Codes

From time to time, we may offer promotional codes (“Promo Codes”) that grant temporary or permanent access to premium features at no cost or at a reduced cost.

  • Promo Codes are provided at our sole discretion and may be subject to additional terms or conditions specified at the time of distribution

  • Each Promo Code may only be redeemed once per account unless otherwise stated

  • Promo Codes cannot be combined with other offers unless explicitly permitted

  • We reserve the right to revoke, expire, or modify Promo Codes at any time without prior notice

  • Promo Codes have no cash value and are not transferable

  • Abuse or unauthorized distribution of Promo Codes may result in suspension or termination of access to premium features

6. Advertisements

6.1 Ad-Supported Service

The free version of the App is supported in part by advertisements provided by Google AdMob.

6.2 Advertisement Types

The App may display:

  • Banner advertisements

  • Interstitial advertisements

  • Rewarded advertisements (optional)

6.3 Ad Personalization

Ads may be personalized based on Google’s advertising services. You can manage ad personalization through your device settings.

6.4 Ad-Free Experience

Premium subscribers enjoy an ad-free experience.

6.5 Third-Party Advertisers

We are not responsible for third-party advertisement content. Any interaction with advertisers is solely between you and the advertiser.

7. User Data and Privacy

7.1 Privacy Policy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

7.2 Data Ownership

You retain ownership of your personal health and fitness data. We store and process this data solely to provide the Service.

7.3 Data Deletion

You may delete your data at any time using the App’s data management features.

8. Acceptable Use

8.1 Prohibited Activities

You agree not to:

  • Use the App for unlawful purposes

  • Attempt unauthorized access to systems or data

  • Reverse engineer or decompile the App

  • Modify, distribute, or create derivative works

  • Transmit malware or harmful code

  • Interfere with other users

  • Misrepresent your identity

  • Use automated systems to access the App

9. Intellectual Property

9.1 Ownership

All content, code, design, and features of the App are owned by J AND K WEB COLLECTIVE (PTY) LTD and protected by intellectual property laws.

9.2 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the App without prior written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

WE DO NOT GUARANTEE THAT:

  • THE APP WILL BE ERROR-FREE OR UNINTERRUPTED

  • DEFECTS WILL BE CORRECTED

  • THE APP IS FREE OF HARMFUL COMPONENTS

  • INFORMATION PROVIDED IS ACCURATE OR COMPLETE

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

  • TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING 12 MONTHS

  • WE ARE NOT LIABLE FOR ANY HEALTH OUTCOMES RESULTING FROM APP USE

12. Indemnification

You agree to indemnify and hold harmless J AND K WEB COLLECTIVE (PTY) LTD from any claims arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of third-party rights

13. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via:

  • In-app notifications

  • Email (if provided)

  • Updated “Last Updated” date

Continued use of the App constitutes acceptance of updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which J AND K WEB COLLECTIVE (PTY) LTD operates, without regard to conflict-of-law principles.

15. Dispute Resolution

Disputes shall first be attempted to be resolved informally. If unresolved, disputes may be subject to binding arbitration under applicable rules.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and J AND K WEB COLLECTIVE (PTY) LTD regarding the App.
